Five Steps to a TN Visa

Rings showing countries involved with NAFTAThe North American Free Trade Act, NAFTA, signed into law by President Clinton, eased the movement of resources, products and people throughout Canada, the United States, and Mexico. Canadian and Mexican natives can travel easily between the three countries, and under the right circumstance, even get visas to work in America.

Professionals who are Canadian or Mexican citizens can file an application allowing them to find work in America. There is no limited number of renewals and the US doesn’t limit the number of TN visas handed out every year. The visa, authorized by NAFTA, is only for Canadians or citizens of Mexico. Immigrants already living in the US are ineligible. Canadian citizens can apply for the visa where they enter the country. Mexican citizens must visit a US Consulate to file the application.

1. Sponsoring Employer. To apply, a person must have a confirmed job offer from an employer who has stated a willingness to file the application for you.

2. Approved TN Profession. The occupation must fall into one of the professional categories covered by NAFTA. A complete list can be seen on the Canadian and Mexican Embassy websites.

3. Meet Requirements. You must meet the burden of proof that you qualify educationally for the job. For many TN occupations, this requires that you have a BA, or its equivalent, in the field. Depending on the job classification, you may be able to substitute five years of documented job experience.

4. Support Letter. Your employer should write a letter supporting your application and the letter should detail 3 things:

A. The letter should thoroughly describe the business.  How many employees, basic financial statement, number of years in business and any relative information should be included.  A letter demonstrating the employer’s need for you to fill the position will help tremendously in the application process.

B. Job Description. A detailed job description describing your duties should be included. The job description is also the place for the employer to explain why filling this position is crucial to the future of the enterprise. Unlike other visas, a TN visa applicant will not be questioned by an immigration officer, so the letter should pack in as much pertinent information as possible.

C. Employee’s Qualifications. Your employer’s letter should explain precisely how you are qualified for this specific position.
